RE: Texas Public Information Act Request

Dear Public Information Coordinator:

Pursuant to the Texas Public Information Act (Texas Government Code Chapter 552), I am requesting on behalf of my wife, ████████████████, copies of the following records related to her (DOB: ██████████) during her incarceration at the Colorado County Jail from January 12, 2026 through January 21, 2026. ████████████████ is copied on this request.

This request relates to the January 19, 2026 incident in which ████████████████ was injured. According to the Colorado County EMS report (Incident #260119-2236-COLORADO), ████████████████ asked to verify her medications and was told she would have to ‘request to see the nurse.’ The EMS report documents that ████████████████ stated she wanted to ’look at the bottles’ and that she ‘reached for her bag of medicine’ — indicating she was attempting to TAKE her medication, not refuse it. I am seeking documentation to verify whether a medication refusal actually occurred as claimed, or whether the ‘refusal’ report was false via radio to Lt. Holly Smith.


REQUESTED RECORDS:

1. RADIO/DISPATCH AUDIO RECORDINGS

All radio transmissions, dispatch audio recordings, and internal jail communications (audio) from January 19, 2026, between the hours of 8:00 PM and 11:00 PM, including but not limited to:

a. Any radio calls regarding inmate ████████████████

b. Any radio calls referencing “medication,” “medcall,” “refusal,” “refusing,” or “non-compliance”

c. Any radio calls requesting supervisor/lieutenant response to the housing area where ████████████████ was housed

d. Any radio calls regarding a “disturbance,” “altercation,” or use of force

e. Any radio calls requesting medical assistance or EMS

2. MEDICATION REFUSAL DOCUMENTATION

a. Any and all “Refusal of Medical Treatment” forms, “Medication Refusal” forms, or equivalent documentation signed by or presented to ████████████████ during her incarceration from January 12–21, 2026

b. If no such forms exist, please confirm in writing that no medication refusal forms were signed by or presented to ████████████████ during this period

3. MEDICATION ADMINISTRATION RECORDS

a. The Medication Administration Record (MAR) for ████████████████ for January 19, 2026, showing all medications administered, times, and administering staff

b. Any documentation of medications NOT administered to ████████████████ on January 19, 2026, and the reason for non-administration

4. MED-PASS PROTOCOLS

a. The jail’s written policy/procedure for medication distribution (“med-pass”)

b. The jail’s written policy/procedure for handling inmate requests to verify medication

c. The jail’s written policy/procedure for documenting medication refusals


As required by the Texas Public Information Act, please respond within ten (10) business days. If any portion of this request is denied, please cite the specific statutory exemption and submit the request to the Texas Attorney General for a ruling.

I am willing to pay reasonable copying costs. Please notify me if costs will exceed $40.00 before proceeding. I prefer to receive responsive documents in electronic format (PDF) via email.
