RE: Request for Court Records — Criminal Case of Tomas Ramirez (former CCSO Deputy)
Dear Ms. Harmon:
Pursuant to the common-law and constitutional rights of public access to court records, Tex. R. Jud. Admin. 12, and to the extent applicable Tex. Gov’t Code Chapter 552 — including § 552.022(a)(17) (information also contained in a public court record is public information) — I respectfully request copies of all publicly available records in the criminal case(s) of Tomas Ramirez, former Colorado County Sheriff’s Office deputy, arising from conduct alleged to have occurred in or about September 2024 and resulting in deferred adjudication community supervision in or about 2025.
Specifically, I request:
- The complete docket sheet;
- The indictment or information, including any superseding or amended charging instrument;
- Any motion, agreement, or order dismissing or amending counts (including any count under Tex. Penal Code § 39.04(a)(2));
- The plea papers, including signed plea admonishments under Tex. Code Crim. Proc. art. 26.13 and any written plea agreement;
- The judgment of deferred adjudication community supervision, conditions of community supervision, and any subsequent modification orders;
- Any pre-sentence investigation report on file, to the extent publicly accessible;
- Any motion or order sealing or restricting access to any portion of the record.
I acknowledge that responsive records may contain information the Court or Clerk is required by law to withhold or redact, including without limitation victim identifying information under Tex. Code Crim. Proc. arts. 57 and 57A, personally identifying information under Tex. Gov’t Code §§ 552.117, 552.130, and 552.147, and information made confidential by statute or court order. I request that all such legally required redactions be applied and the remainder of the records be produced. If any responsive document is withheld in its entirety, I respectfully request an itemized index identifying the document, the asserted statutory or other basis for withholding, and a description sufficient to permit review.
PUBLIC-INTEREST ACCOMMODATION REQUEST. I acknowledge that copies of court records are produced under the statutory fee schedule prescribed by Tex. Gov’t Code §§ 51.318–51.319 and the applicable local rules, and that the Clerk’s fees are not subject to the discretionary fee-waiver provision applicable to governmental bodies under the Texas Public Information Act, Tex. Gov’t Code § 552.267(a). To the extent the Clerk has discretion to extend any accommodation — such as waiver of certification fees on plain copies, electronic delivery in lieu of paper, or any other administrative reduction — I respectfully request such accommodation in light of the public-interest purpose of this request. All responsive records produced under this request will be made publicly available at aiether.info within seven (7) business days of receipt, with mandatory redactions applied.
Please advise of the applicable copy and certification fees (after any accommodation extended), and I will promptly remit payment.
